Background of the Lawsuit

Tom’s of Maine, Inc., a subsidiary of Colgate-Palmolive Company, manufactures toothpaste products sold through third-party retailers across the United States. In May 2024, an FDA inspection of Tom’s manufacturing facility in Sanford, Maine found that certain conditions were not in compliance with the FDA’s Current Good Manufacturing Processes. Following the inspection, the company reviewed pre-release testing data for approximately 4,900 finished toothpaste batches produced over a three-year period and reported that no batch presented a safety risk to consumers.

Multiple lawsuits were filed alleging that Colgate-Palmolive and Tom’s engaged in deceptive and misleading business practices related to the manufacturing, marketing, and sale of Tom’s toothpaste products. The cases were consolidated and are being overseen by Judge James M. Wicks of the U.S. District Court for the Eastern District of New York. Colgate-Palmolive and Tom’s deny all allegations of wrongdoing and deny any liability. They agreed to the $2,900,000 settlement to avoid the costs and risks of continued litigation. For more information, visit the official settlement website. The settlement has not yet received final court approval.
