To get paid from the Colgate-Palmolive settlement:
Without proof of purchase: average manufacturer’s suggested retail price for up to one (1) Class Product per household. With proof of purchase: full refund of amount spent on Class Products, capped at three (3) products per household.
Colgate-Palmolive settlement payments vary depending on whether you submit proof of purchase. Without proof of purchase, you may receive the average manufacturer’s suggested retail price for up to one Tom’s of Maine toothpaste product per household. With proof of purchase, you may receive a full refund of what you paid for up to three products per household. If total approved claims exceed the available funds, all payments will be reduced proportionally. Payments can be received digitally via PayPal, Venmo, or Zelle, or by mailed check. Payments will not be distributed until after the court grants final approval at the September 10, 2026 hearing and any appeals are resolved.
Tom’s of Maine, Inc., a subsidiary of Colgate-Palmolive Company, manufactures toothpaste products sold through third-party retailers across the United States. In May 2024, an FDA inspection of Tom’s manufacturing facility in Sanford, Maine found that certain conditions were not in compliance with the FDA’s Current Good Manufacturing Processes. Following the inspection, the company reviewed pre-release testing data for approximately 4,900 finished toothpaste batches produced over a three-year period and reported that no batch presented a safety risk to consumers.
Multiple lawsuits were filed alleging that Colgate-Palmolive and Tom’s engaged in deceptive and misleading business practices related to the manufacturing, marketing, and sale of Tom’s toothpaste products. The cases were consolidated and are being overseen by Judge James M. Wicks of the U.S. District Court for the Eastern District of New York. Colgate-Palmolive and Tom’s deny all allegations of wrongdoing and deny any liability. They agreed to the $2,900,000 settlement to avoid the costs and risks of continued litigation.
