Background of the Lawsuit

This settlement resolves investigations by 35 State Attorneys General into Hyundai and Kia’s failure to install engine immobilizers in millions of vehicles, which led to a surge in vehicle thefts known as the ‘Kia Boyz’ trend. The states alleged this failure violated consumer protection laws. While separate from the private class action lawsuit, this $9 million agreement provides specific restitution for consumers in participating states who suffered losses despite getting the software update, alongside a mandatory free hardware fix for affected vehicles.

Frequently Asked Questions

What is the difference between this settlement and the private class action?
This is a $9 million government settlement reached with State Attorneys General, specifically for consumers in 35 states who suffered thefts after April 2025. The private class action (Hagens Berman case) is a separate $145 million settlement covering a broader range of past claims nationwide.
You may be eligible for up to $4,500 if your vehicle was a total loss due to theft, up to $2,250 for damage from a partial loss, or up to $375 for expenses related to an attempted theft.
The settlement covers 35 jurisdictions including Arizona, California, Connecticut, Florida, Illinois, New York, Pennsylvania, Washington, and others listed in the eligibility section. If you live in a non-participating state, you may still be eligible for the separate private class action.
The deadline to submit a claim for reimbursement is March 31, 2027. However, funds are limited and paid on a rolling basis, so it is recommended to file as soon as possible.
