To get paid from the Widener University settlement:
No claim form is required. If the Court grants final approval, your payment will be mailed automatically by first class U.S. Mail to the permanent address Widener has on file for you. You don’t need to do anything to receive your check.
You do have a few optional steps you can take to update your payment preferences before the deadline, which will be posted on the settlement website after the Final Approval Hearing scheduled for June 30, 2026.
No proof of purchase required. Class members automatically receive payment if settlement is approved; no claim form required to participate.
Widener University settlement payments are an equal share of the Net Settlement Fund, meaning the exact amount per person depends on how many class members participate. The $800,000 gross fund will be reduced by attorneys’ fees (up to 33.3%), administrative costs (projected up to $50,000), and a representative award of up to $2,500 before the remainder is split equally among eligible class members. Payments will be sent by paper check via first class U.S. Mail, or by Venmo or PayPal if you submit an Election Form. Checks will go out within 60 days after the settlement becomes final, which will be some time after the Final Approval Hearing currently scheduled for June 30, 2026.
Plaintiff Gianna Sparacino sued Widener University on behalf of students who paid tuition and fees for the Spring 2020 semester but were moved to remote learning after COVID-19 forced the university to close its physical campus. The lawsuit alleged breach of contract and unjust enrichment, arguing that students paid for in-person instruction and on-campus services they didn’t receive.
Widener denied all allegations of wrongdoing and maintained that its actions were proper under its policies and applicable law. No court has found the university liable. After motions practice, discovery, and negotiations, both sides agreed to resolve the case.
The settlement establishes an $800,000 fund to be distributed equally among class members. Widener also agreed to provide each class member five complimentary tickets to regular season athletic events and free access to the Pride Recreation Center, both valid between July 1, 2026 and June 30, 2027.
