Eligible class members can claim up to $5,000 for documented, unreimbursed losses tied to the breach, such as costs related to identity theft, fraud, or misuse of personal information. On top of that, all class members who submit a valid claim form can receive a pro rata cash payment of up to $100. Both amounts may be adjusted up or down depending on the total number of approved claims submitted. Payments will be sent by the settlement administrator after the court grants final approval and any appeals are resolved.
The lawsuit, Rivera et al. v. Essen Medical Associates, P.C., was filed after an unauthorized party accessed Essen’s data environment between March 14, 2023, and March 22, 2023. Plaintiffs alleged that the breach exposed the personal information of patients and others who had entrusted their data to Essen Medical Associates, a New York-based medical provider. For more information, visit the official settlement website.
The complaint asserts claims including negligence, breach of implied contract, breach of fiduciary duty, violations of New York General Business Law Section 349, and unjust enrichment. Essen denies all allegations of wrongdoing or liability.
Rather than continue to trial, both sides agreed to a $4,000,000 settlement fund. The court preliminarily approved the settlement on January 27, 2026, and class members were notified in March 2026. Final approval is scheduled to be considered at a hearing on July 7, 2026.
