What You Need to Do to Get Paid

To get paid from the Essen Medical Associates settlement:

Claim by Mail

  1. Download and complete the official Claim Form from the settlement website.
  2. Gather any documentation of unreimbursed losses you incurred as a result of the breach, such as receipts or records related to identity theft remediation, fraud charges, or misuse of personal information.

Estimated Payout Per Person

Essen Medical Associates settlement payments are up to $5,100 per person. Eligible class members can claim up to $5,000 for documented, unreimbursed losses tied to the breach, such as costs related to identity theft, fraud, or misuse of personal information. On top of that, all class members who submit a valid claim form can receive a pro rata cash payment of up to $100. Both amounts may be adjusted up or down depending on the total number of approved claims submitted. Payments will be sent by the settlement administrator after the court grants final approval and any appeals are resolved.

The lawsuit, Rivera et al. v. Essen Medical Associates, P.C., was filed after an unauthorized party accessed Essen’s data environment between March 14, 2023, and March 22, 2023. Plaintiffs alleged that the breach exposed the personal information of patients and others who had entrusted their data to Essen Medical Associates, a New York-based medical provider.
