Eligible States
To get paid from the Gen Digital TCPA IVR settlement:
Visit the settlement website at https://www.jacksonivrsettlement.com/ and submit your claim form online. Follow the instructions provided to complete your claim.
Print the claim form from the settlement website, complete it, and mail it to the Settlement Administrator. Include any required supporting documentation with your submission.
Check the settlement website for the specific deadline and mailing address for your claim submission.
Class members can file without proof of purchase. If you did not receive a claim form in the mail but believe you are a settlement class member, you must provide evidence of having received an artificial or prerecorded voice call from Gen regarding a LifeLock or Norton account during the settlement period and attest that you were not a customer at that time. The claims administrator will then send you a claim form.
Gen Digital settlement payments will be distributed to class members who submit valid claim forms. The estimated per-person payout ranges from $200 to $625, depending on the number of participating class members. Each claimant receives an equal pro rata share of the remaining settlement fund after deductions for administration, attorneys’ fees, litigation costs, and the plaintiff’s service award.
Michelle Jackson filed a class action lawsuit against Gen Digital Inc., alleging that the company violated the Telephone Consumer Protection Act (TCPA) by using artificial or prerecorded voices to make calls regarding LifeLock and Norton accounts to cellular telephone numbers of persons who were not customers or account holders. The TCPA provides for statutory damages of $500 per violation, up to $1,500 for willful violations.
Gen Digital denies the allegations and denies violating the TCPA. The company asserts that prior express consent and emergency purposes are complete defenses to TCPA claims. The court did not decide who was right or wrong. Instead, the parties agreed to settle the matter to avoid the time, risk, and expense of continued litigation. Under the settlement, class members who submit valid claim forms will receive compensation from a $9.95 million settlement fund.
