To get paid from the Seafood City Supermarkets settlement, no claim form is required. Payments are distributed automatically to all identified class members.
If you received a notice, you are already considered a member of the Settlement Class. You don’t need to do anything to receive your payment. Checks will be mailed within 28 days after the court order becomes final, following the Final Approval Hearing on June 17, 2026.
Checks expire and become void 120 days after they are issued, so cash yours promptly once it arrives.
All Settlement Class Members automatically receive equal gross share of approximately $751.87 less deductions, with estimated net payment of $417.00 per member. No proof of employment or hand scan enrollment required to receive payment.
Seafood City Supermarkets settlement payments are approximately $417 per person (net), after deductions for attorneys’ fees of up to 37.5%, administration costs, and a service award to the named plaintiff. The gross share per class member is approximately $751.87 before those deductions.
Payments will be issued by check, mailed within 28 days after the settlement becomes final. Checks are valid for 120 days from the date issued. No claim form is required — eligible class members receive payment automatically.
A former Seafood City employee filed suit against SFC Foods Chicago Inc., which operates Seafood City Supermarkets, alleging the company collected workers’ hand scan data for timekeeping without first providing required written disclosures or obtaining written consent. Those requirements come from the Illinois Biometric Information Privacy Act, known as BIPA, which restricts how private companies can collect and use biometric data like hand scans and fingerprints.
The lawsuit covers employees at Illinois Seafood City locations from January 22, 2019 through May 22, 2024. Seafood City denies any wrongdoing and contests the claims, but agreed to settle to avoid the costs and uncertainty of continued litigation.
The $300,000 settlement fund will be divided equally among class members. After deductions for attorneys’ fees, administration costs, and a service award to the named plaintiff, each class member is estimated to receive approximately $417. The Cook County Circuit Court granted preliminary approval, with a Final Approval Hearing set for June 17, 2026.
