What is Final Approval Hearing (fairness Hearing)?

Class action glossary term

Short Definition

A court hearing where the judge decides whether the settlement is fair, reasonable, and adequate—and whether to approve it.

What It Means

At the final approval hearing, the court considers the settlement terms, objections, opt-outs, and the plan for distributing benefits. If the court approves the settlement, payments still may not go out immediately—appeals or administrative steps can delay distribution.

Example

Example: The hearing occurs months after the claim deadline, after the administrator compiles claim statistics.

Why It Matters

It’s the point where the settlement becomes binding if approved and not overturned on appeal.
