Who’s Eligible

You may be eligible for the Werner Enterprises settlement if you:

  • Worked as a qualified driver for Werner Enterprises or Drivers Management, LLC between June 4, 2010, and July 14, 2023
  • Are a member of the Nebraska Settlement Class (worked for Werner anywhere in the United States as a qualified driver during the class period)
  • Are a member of the California Settlement Class (resided in California, worked as a qualified driver for Werner during the class period, and picked up or delivered at least one load in California)
  • Are not a student driver (placement driver) or owner operator

What You Need to Do to Get Paid

To get paid from the Werner Enterprises settlement:

No claim form is required. If you worked as a qualified driver for Werner Enterprises between June 4, 2010, and July 14, 2023, you are automatically eligible and will receive payment without taking any action.

Werner Enterprises settlement payments are at least $20 per Nebraska class member and at least $40 per California class member, plus a pro-rata share of remaining funds based on weeks worked during the class period. All eligible class members receive automatic payment by mail or electronic transfer (PayPal) without filing a claim.

Background of the Lawsuit

Several former drivers filed a lawsuit in 2014 claiming Werner Enterprises violated Nebraska and California law by failing to pay qualified drivers minimum wage for all work time and failing to comply with other wage protection laws. Seven Class Representatives were appointed: Ezequiel Olivares Abarca, Alfredo Alesna, David Cagle, Stephen Davis, Frank Eads, Kenneth Surman, and William Smith. The lawsuit was consolidated with two other similar actions, Smith v. Werner Enterprises, Inc. (Case No. 8:15-cv-287) and Vester v. Werner Enterprises, Inc. (Case No. 8:17-cv-145).

Werner denies the allegations and contends it paid drivers in accordance with applicable law. In October 2025, the parties agreed to settle to avoid the costs and risks of continuing the case. The $18 million settlement provides automatic payment to all eligible class members and resolves all wage and hour claims for the Nebraska and California classes, subject to final court approval scheduled for July 24, 2026. Who qualifies for the Werner Enterprises settlement?
You qualify if you worked as a qualified driver for Werner Enterprises between June 4, 2010, and July 14, 2023. Student drivers and owner operators are excluded. California class members must have also picked up or delivered at least one load in California.
