Several former drivers filed a lawsuit in 2014 claiming Werner Enterprises violated Nebraska and California law by failing to pay qualified drivers minimum wage for all work time and failing to comply with other wage protection laws. Seven Class Representatives were appointed: Ezequiel Olivares Abarca, Alfredo Alesna, David Cagle, Stephen Davis, Frank Eads, Kenneth Surman, and William Smith. The lawsuit was consolidated with two other similar actions, Smith v. Werner Enterprises, Inc. (Case No. 8:15-cv-287) and Vester v. Werner Enterprises, Inc. (Case No. 8:17-cv-145).
Werner denies the allegations and contends it paid drivers in accordance with applicable law. In October 2025, the parties agreed to settle to avoid the costs and risks of continuing the case. The $18 million settlement provides automatic payment to all eligible class members and resolves all wage and hour claims for the Nebraska and California classes, subject to final court approval scheduled for July 24, 2026.
