Colgate Tom's of Maine Toothpaste Settlement Claims Open: No Proof

Tom’s of Maine toothpaste buyers can now file a claim against Colgate-Palmolive as part of a $2.9 million class action settlement. The deadline is July 6, 2026.

You don’t need a receipt to file. But if you submit proof of purchase (like an itemized receipt or loyalty card record), you can claim a refund for up to three products instead of one.

What Is This Settlement About?

Tom’s of Maine, Inc. is a subsidiary of Colgate-Palmolive that sells toothpaste through retailers nationwide. In May 2024, an FDA inspection of Tom’s manufacturing facility in Sanford, Maine found certain conditions were not in compliance with the FDA’s Current Good Manufacturing Processes.

After the inspection, Tom’s reviewed pre-release testing data for approximately 4,900 finished toothpaste batches produced over three years. The company reported that no batch presented a safety risk to consumers.

Multiple lawsuits followed, alleging that Colgate-Palmolive and Tom’s engaged in deceptive and misleading practices related to the manufacturing, marketing, and sale of Tom’s products. Those cases were consolidated and are being overseen by Judge James M. Wicks of the U.S. District Court for the Eastern District of New York.

The case (Rabinowitz et al. V. Colgate-Palmolive Company et al., Case No. 2:25-cv-6996 (JMW) (E.D.N.Y.), United States District Court, Eastern District of New York) settled for $2.9 million. Both companies deny all allegations of wrongdoing and deny any liability. They agreed to the deal to avoid the costs and risks of continued litigation.

Settlement Eligibility: Who Can File?

You may qualify as a class member if you meet all three of the following criteria:

• Purchased one or more Tom’s of Maine toothpaste products within the United States
• Made your purchase between November 21, 2020, and March 6, 2026 (Class Period)
• Bought the product for personal use, not for resale or distribution

There are no geographic restrictions. The settlement is open nationwide.

How Much Are Settlement Checks Worth?

Attorney fees, service awards, and administrative costs come out of the fund before any payments reach class members. Your individual payout will reflect what’s left after those deductions, divided across all approved claims.

Settlement Terms

Submitting a Claim

There are two ways to submit a claim in the Tom’s of Maine Toothpaste settlement: online or by mail.

Claim Online

1. Visit the official settlement claim site to file your claim form.
2. Complete all required fields, including your name, contact information, and purchase details.
3. Select your claim type: without proof of purchase (up to one product per household) or with proof of purchase (up to three products per household).
4. Choose your preferred payment method: PayPal, Venmo, Zelle, or a mailed check.
5. Submit your claim no later than July 6, 2026.

Claim by Mail

1. Download and print the claim form from the official settlement website, or request a paper copy by calling 1-877-315-6779 or emailing the Class Administrator.
2. Complete and sign the form, including your name, address, and purchase information.
3. If claiming with proof of purchase, attach an itemized receipt or loyalty card record showing the purchase price, date, place, and number of units bought.
4. Mail your completed form to the Class Administrator (Epiq Global) so it is postmarked no later than July 6, 2026.
