Background of the Lawsuit

This settlement resolves a class action lawsuit brought by commercial and industrial customers against BFI Waste Services and its corporate affiliates. The plaintiffs alleged that the defendants increased prices for waste hauling and recycling services in excess of amounts allowed under the customers’ contracts, which contained rate adjustment provisions tied to cost increases and CPI adjustments.

The defendants agreed to establish a settlement fund to compensate class members who paid unauthorized price increases. Under the settlement, eligible customers can receive $100 by providing their account number, or $200 or more by submitting proof of their contract and evidence of the price increase. The settlement covers customers in 13 states and Jefferson County, Alabama who had automatically renewing contracts during the relevant class period.
