The lawsuit centers on how Discover categorized certain consumer credit cards, including rewards cards, as “commercial” cards. This is one of several recent finance settlements.
That distinction mattered because interchange fees, the per-transaction fees paid when a customer swipes a card, can vary depending on the card type. Plaintiffs allege that Discover’s misclassification caused merchants and payment processors to pay higher fees than they should have for more than 15 years.
Discover denies any wrongdoing. The company agreed to the $1.225 billion settlement to avoid trial, not as an admission of liability. The court granted preliminary approval of the modified settlement agreement on July 30, 2025.

In all cases, your transactions must have included what the settlement calls “Misclassified Card Transactions,” meaning consumer cards that were incorrectly categorized as commercial cards.
The settlement fund of $1.225 billion will cover valid claims, attorney fees of up to $25 million, case expenses of up to $1 million, and service awards of up to $7,500 each for the class representatives who brought the case.
Payments to qualifying claimants will be at least $10, though individual amounts will depend on the volume and nature of a claimant’s Discover transactions. As a class action settlement, the final per-claimant distribution is determined after all valid claims are counted and approved by the court.
