Background of the Lawsuit

This case involves allegations that JustPlay GMBH and Gimica GMBH (doing business as JustPlay and GIMICA Games) improperly collected, stored, and used biometric information from users of the JustPlay mobile application without obtaining their prior written consent. Plaintiff Angela Brewer alleges the defendants violated Illinois’ Biometric Information Privacy Act (BIPA) by capturing and processing facial images of users via third-party software implemented within the app.

JustPlay denies it did anything wrong, and the Court has not decided who is right. Rather than continue with litigation, the parties agreed to settle to avoid costs, risks, disruption, and uncertainty of continued proceedings. Under the settlement, class members can claim a one-time $15.00 payment without proving purchase or use of the app.
