Eligible States
To get paid from the GlaxoSmithKline settlement:
$50 with Qualifying Proof of Vaccination (healthcare provider records, insurer records, or medical documentation created before Feb 10, 2025); $10 with Attestation of Vaccination only (sworn statement, no documentary proof required).
GlaxoSmithKline settlement payments are either $50 or $10 per claimant, depending on whether you provide proof of vaccination. Submit a Qualifying Proof of Vaccination (records from your doctor, pharmacy, or insurer dated before February 10, 2025) and you’ll receive $50. Submit the claim form with only an attestation and no supporting documents, and the payment is $10. Only one claim may be filed per class member. Payment can be issued via Venmo, Zelle, virtual prepaid card, or physical check. Payments won’t go out until after the Final Approval Hearing on July 2, 2026, and any appeals are resolved.
Lead Plaintiff Lori DeCostanzo filed suit against GlaxoSmithKline plc and GlaxoSmithKline LLC in the United States District Court for the Eastern District of New York, case no. 2:21-cv-04869-NJC-AYS. The lawsuit claims that GSK’s “Big Bad Cough” advertising campaign, which ran from 2015 to 2020 and featured animated wolves in each ad, misled viewers about BOOSTRIX’s ability to prevent vaccinated individuals from transmitting pertussis (whooping cough) to others.
GSK has denied all allegations and maintains that BOOSTRIX remains FDA-approved for immunization against pertussis, tetanus, and diphtheria. GSK also notes that the plaintiff did not allege she contracted or transmitted pertussis, and that the advertising campaign accurately reflected CDC guidance in effect at the time. The plaintiff did not challenge the safety or effectiveness of BOOSTRIX for protecting the people who received the vaccine.
Neither side has won in court. GSK agreed to settle to avoid the cost and uncertainty of continued litigation. The settlement is not an admission of wrongdoing.
