No Claim Form Required
If you received a notice, you are automatically eligible based on TTCU’s records. Current TTCU customers will automatically receive account credits within 60 days of the Effective Date. Former customers will receive checks from the Settlement Administrator.
Opt Out (Exclude Yourself)
If you do not want to participate, send a letter to the Settlement Administrator postmarked by March 8, 2026, stating you elect to be excluded. Include your name, last four digits of account number(s), address, telephone, and email.
Object to the Settlement
If you believe the settlement is unfair, file a written objection with the Settlement Administrator postmarked by March 8, 2026, explaining your reasons and whether you intend to appear at the Final Approval Hearing on April 28, 2026.
No proof of purchase required. Class members are automatically eligible based on TTCU’s account records showing they were charged APSN Fees, ACH RET Fees, Multiple NSF Fees, or NSF/OD Fees during the Class Period (August 31, 2015 through May 1, 2024). No claim form must be submitted unless the class member opts out or objects.
TTCU Federal Credit Union settlement payments are distributed based on the amount of applicable fees (APSN Fees, NSF Fees, or OD Fees) charged to each class member. Current TTCU customers receive account credits within 60 days of the Effective Date. Former customers receive checks from the Settlement Administrator. Class members with outstanding balances receive credits for uncollected overdraft or insufficient funds fees. Payments are distributed pro rata from the Net Settlement Fund after deductions for attorneys’ fees, costs, and administration expenses.
Sarah Lee, Edwyna Synar, and Claudia King sued TTCU Federal Credit Union (formerly TTCU the Credit Union, formerly Tulsa Teachers Credit Union) alleging the credit union improperly assessed overdraft and insufficient funds fees on customer accounts between August 31, 2015, and May 1, 2024. Plaintiffs claimed TTCU charged APSN Fees on debit card transactions that were authorized with sufficient funds but posted with insufficient funds, charged ACH RET Fees and Multiple NSF Fees without proper authorization, and charged overdraft or NSF fees instead of the lower transfer fees when customers had sufficient funds in savings accounts. The plaintiffs asserted claims for breach of contract, breach of the covenant of good faith and fair dealing, and unjust enrichment.
TTCU denied all allegations and maintained it assessed all fees in accordance with its account agreements and applicable law. After nearly four years of litigation, including discovery, depositions, two unsuccessful mediation sessions, and ongoing settlement negotiations, the parties reached this settlement. TTCU continues to deny liability but agreed to settle to avoid further litigation expense and uncertainty.
