  • All living individuals in the United States whose private information (full names, dates of birth, Social Security Numbers, hospital admit/discharge dates, outstanding balances, health insurance information) was compromised in the targeted cyberattack on Medibase’s computer systems on or around January 26, 2024.
  • Individuals who received a breach notification letter from the Data Incident are presumed to be class members.
  • Excluded: (a) all directors, officers, and agents of Staten Island University Hospital; (b) governmental entities; (c) the Judge assigned to the action, the Judge’s immediate family, and court staff; (d) anyone who validly opts out of the settlement.

Background of the Lawsuit

This settlement resolves a class action lawsuit arising from a January 2024 targeted cyberattack on Medibase Group Inc., a healthcare solutions provider that served Staten Island University Hospital. The cyberattack exposed the private information of approximately 35,000 individuals, including patient names, dates of birth, Social Security Numbers, hospital admission and discharge dates, outstanding balances, and health insurance information.

The lawsuit, titled Belle De Santiago and Elena Girenko v. Staten Island University Hospital (Case No. 25CVE0998), was filed in the Superior Court of Cherokee County, Georgia. The plaintiffs alleged claims for negligence, breach of implied contract, and unjust enrichment. Staten Island University Hospital denies liability and has not admitted wrongdoing. The hospital’s own computer systems were not impacted by the cyberattack. The parties agreed to settle to avoid the costs, risks, and uncertainties of continued litigation.

The settlement provides class members with medical identity theft monitoring, out-of-pocket loss reimbursement, and flat cash payments. The court has conditionally certified the settlement class and preliminary approval was granted on December 18, 2025. A final approval hearing is scheduled for March 31, 2026.
