Background of the Lawsuit

In May 2025, Roush Fenway Keselowski Racing suffered a targeted cyberattack on its computer systems. Certain files containing private information were accessed during the incident, potentially including names and Social Security numbers. RFK Racing sent notice to affected individuals in September 2025.

Plaintiffs Wyatt Cowley and Craig W. Bagley filed a lawsuit — Wyatt Cowley, et al. v. Roush Fenway Keselowski Racing, LLC, Case No. 1:25-cv-00891 — in the United States District Court for the Middle District of North Carolina, alleging the company failed to adequately protect their personal data.

RFK Racing denies any wrongdoing, and the court has not decided who is right. Both sides agreed to settle to avoid the costs and uncertainties of a trial. The settlement is pending final approval at a hearing scheduled for June 15, 2026. For more information, visit the official settlement website.
