To get paid from the Presbyterian Healthcare Services settlement, no claim form is required. This is an automatic distribution settlement.
If the Court grants final approval, the Claims Administrator will mail a check to your last known address. You do not need to take any action to receive your payment.

Presbyterian Healthcare Services settlement payments are an equal share of the $2,465,000 allocated to class members, with the exact per-person amount depending on how many eligible class members participate. The Claims Administrator will calculate individual allocations.
Payments will be mailed by check to each class member’s last known address after the Court grants final approval of the settlement. The Final Approval Hearing is scheduled for July 13, 2026. Checks that are not cashed within 150 days of distribution will be reallocated equally among class members who did cash theirs.
The lawsuit, McLarty, et al. v. Presbyterian Healthcare Services, Inc. (Case No. D-101-CV-2020-01566), was filed in the First Judicial District Court of New Mexico by plaintiffs Eilene McLarty and Ernestine Jaramillo. They alleged that Presbyterian misrepresented Dr. Guy Rosenschein as a qualified pediatric surgeon and urologist while he was employed at Presbyterian between November 26, 2012, and December 31, 2016. The suit sought compensation for fees paid for Dr. Rosenschein’s services.
Presbyterian denies all allegations. The healthcare system contends that Dr. Rosenschein was properly qualified and credentialed, and that it owed no compensation to patients’ families. The Court has not ruled on the merits of either side’s position.
Rather than take the case to trial, where the outcome was uncertain and damages were already limited by a court ruling, the parties agreed to a $3,500,000 settlement. Of that amount, $2,465,000 is set aside for payments to class members, with each eligible parent or guardian receiving an equal share.
