What to Include

For out-of-pocket losses: Submit reasonable documentation such as credit card statements, bank statements, invoices, receipts, or telephone records showing losses fairly traceable to the data breach (up to $7,500 total).

For lost time: If related to an out-of-pocket loss claim, provide certification for up to 10 hours at $25/hour. For self-certified lost time unrelated to out-of-pocket losses, provide a certified explanation of the misuse or preventative measures and attest to up to 5 hours at $25/hour.

For alternative cash payment: No documentation needed. Non-California residents receive $50; California residents receive $150. California residents must attest they were a California resident on March 29, 2023.

Identity Defense Services

No claim needed to enroll. After final approval, you can enroll in free three-year Identity Defense Services and Restoration Services anytime during the service period.

Out-of-pocket loss claims require reasonable documentation such as credit card statements, bank statements, invoices, telephone records, and receipts. Lost time related to out-of-pocket losses can be supported by certification for up to 10 hours. Self-certified lost time claims (up to 5 hours) require only a certified explanation of the misuse or preventative measures taken. Alternative cash payment claims require no supporting documentation.

NextGen Healthcare settlement payments depend on your claim type. You can request an Alternative Cash Payment of $50 (or $150 if a California resident), claim reimbursement for out-of-pocket losses up to $7,500, or claim lost time at $25 per hour. Payments are subject to pro rata adjustment based on total valid claims. If funds remain after claims, payments increase up to a maximum of $599 per person, and remaining funds extend Identity Defense Services or go to cybersecurity organizations via cy pres distribution.

Background of the Lawsuit

On April 28, 2023, NextGen Healthcare announced it had detected a cyberattack in which unauthorized parties gained access to patient data. The class action alleges NextGen Healthcare failed to properly protect personal information, maintained inadequate data security, and violated state consumer protection statutes and other laws. Various lawsuits were consolidated into Miller v. NextGen Healthcare Inc., Case No. 1:23-cv-02043-TWT.

NextGen Healthcare denies all allegations. The parties did not litigate the claims to judgment. Instead, after mediation, both sides agreed to a settlement that avoids the costs and uncertainty of trial while providing faster benefits to class members. The Court approved the settlement on February 17, 2026.
