Settlement Payout
Kittles Home Furnishings settlement payments range from $50 to $5,000 depending on which type of claim you submit. The simplest option is the $50 alternative cash payment, which requires no documentation. If you had out-of-pocket expenses tied to the breach, you can claim up to $500 for ordinary losses or up to $5,000 for extraordinary losses such as documented identity theft or fraud, both requiring third-party documentation. You can also claim up to $90 for lost time spent dealing with the breach’s effects, calculated at $22.50 per hour for up to four hours. Payments will be processed after the court grants final approval and any appeals are resolved, which could take more than a year from the May 18, 2026 hearing.

Background of the Lawsuit
In September 2024, plaintiff Christopher M. Ballard filed a lawsuit against Kittles Home Furnishings, Inc. in Marion County Superior Court in Indiana. The complaint alleged that cybercriminals gained unauthorized access to the company’s networks between February 7 and February 17, 2023, compromising personal information belonging to Kittles employees. The claims included negligence, negligence per se, breach of implied contract, unjust enrichment, and bailment.
Kittles denies all allegations and denies any liability. No court has found that the company did anything wrong. Rather than continue litigating, both sides agreed to resolve the case through a class-wide settlement to avoid the time and expense of a trial.
