Your claim must be electronically submitted or postmarked by April 6, 2026 to be valid. Each approved claimant will receive an equal pro rata share of the Net Settlement Fund by check, Venmo, or PayPal (your choice). Checks expire 120 days after issuance.
No proof of purchase or website visit is required to submit a claim. Claimants must provide their name, address, email associated with their Inova MyChart account, and attest that they visited an Inova public-facing website between April 29, 2022 and April 29, 2024 while having an Inova MyChart Account.
Inova Health Care Services settlement payments are distributed equally to all approved claimants. The per-person amount is unknown and will depend on the number of valid claim forms submitted. Each approved claimant receives the same pro rata share of the Net Settlement Fund after deductions for administration expenses, court-approved attorneys’ fees, and the class representative service award.
This settlement resolves a class action lawsuit titled Lugo v. Inova Health Care Services, pending in the United States District Court for the Eastern District of Virginia. The lawsuit alleges that Inova Health Care Services collected and disclosed patients’ Personally Identifiable Information (PII) and Protected Health Information (PHI) through third-party tracking technologies known as tracking pixels on its public-facing websites, in violation of the federal Electronic Communications Privacy Act (ECPA).
Inova denies all allegations of wrongdoing and maintains it has not disclosed any patients’ Private Information. Inova also disputes that the information collected is protected under the Health Insurance Portability and Accountability Act (HIPAA). However, to avoid the uncertainties and expenses of continued litigation, both sides agreed to settle the case.
Under the settlement, Inova will pay $3,147,390.04 into a Settlement Fund and implement remedial measures to ensure its use of tracking pixels complies with the ECPA and HIPAA going forward.
