Settlement Class Members need only submit one Claim Form to receive payment for all text messages and calls received. No proof of purchase required — claimants attest under penalties of perjury that they submitted consumer lead information to Kelley Blue Book and received more than one text message or call from Infiniti within a 12-month period while their telephone number was listed on the National Do Not Call Registry for at least thirty days.
Infiniti of Clarendon Hills settlement payments are up to $150 per person for eligible class members who submit a valid claim form. You only need to file one claim form, regardless of how many texts or calls you received. If the total number of valid claims exceeds what the fund can cover at $150 each, payments will be reduced proportionally. The settlement fund is $552,600, and payments will not be issued until the court grants final approval and any appeals are resolved. No specific payment method or timeline has been announced yet.
Plaintiff Kevin Galindo filed a lawsuit against Infiniti of Clarendon Hills, Inc., an automotive dealership in Clarendon Hills, Illinois, alleging the company violated the Telephone Consumer Protection Act (TCPA). The lawsuit claims that Infiniti sent text messages and made calls to consumers who had submitted lead information through Kelley Blue Book, even though those consumers’ phone numbers were listed on the National Do Not Call Registry for at least 30 days. The alleged contacts occurred more than once within 12-month periods, starting February 6, 2021.
Infiniti denies all allegations of wrongdoing and does not admit to any misconduct as part of this settlement. The court has not ruled on who is right. Both sides agreed to settle to avoid the cost and uncertainty of going to trial.
