Background of the Lawsuit

Plaintiff Kevin Galindo filed a lawsuit against Infiniti of Clarendon Hills, Inc., an automotive dealership in Clarendon Hills, Illinois, alleging the company violated the Telephone Consumer Protection Act (TCPA). The lawsuit claims that Infiniti sent text messages and made calls to consumers who had submitted lead information through Kelley Blue Book, even though those consumers’ phone numbers were listed on the National Do Not Call Registry for at least 30 days. The alleged contacts occurred more than once within 12-month periods, starting February 6, 2021.

Infiniti denies all allegations of wrongdoing and does not admit to any misconduct as part of this settlement. The court has not ruled on who is right. Both sides agreed to settle to avoid the cost and uncertainty of going to trial.

The settlement creates a settlement fund of up to $552,600. Class members who file a valid claim can receive up to $150 per person. For more information, visit the official settlement website. One claim form covers all qualifying texts and calls a class member received.
