Who’s Eligible

You are eligible if you fall into one of these groups between Jan 1, 2007 and Dec 31, 2023:

  • End Merchants: Businesses that accepted Discover cards directly.
  • Merchant Acquirers: Entities with agreements to facilitate Discover transactions.
  • Payment Intermediaries: Entities that processed Discover transactions for others.
  • Your transactions must have included ‘Misclassified Card Transactions’ (consumer cards wrongly listed as commercial).

What You Need to Do to Get Paid

Online: Visit www.DiscoverMerchantSettlement.com and use your Claimant ID and PIN to file. If you don’t have one, you can register on the site. 

Mail: Download the Claim Form from the website and mail it to: Discover Merchant Settlement, c/o Epiq Class Action, P.O. Box 2497, Portland, OR 97208-2497.

Most eligible merchants will receive a notice with a Claimant ID and PIN to file online. If you do not have a code, you can still register and file by providing your business details.

Settlement Payout

Estimated Payout Per Person

Payments depend on the amount of interchange fees you paid. All valid claims will receive at least $10. The fund will pay out between $540 million and $1.225 billion.

The $1.225 billion fund will be used to pay:

  • Valid Claims: Payments to merchants who were overcharged.
  • Lawyer Fees: Up to $25 million.
  • Expenses: Up to $1 million.
  • Service Awards: Up to $7,500 each for the Class Representatives.

Plaintiffs allege that Discover misclassified certain consumer credit cards (like rewards cards) as ‘commercial’ cards. This misclassification allegedly caused merchants to pay higher interchange fees than they should have between 2007 and 2023. Discover denies any wrongdoing but agreed to settle to avoid trial.
