What You Need to Do to Get Paid

To get paid from the CommuniCare settlement:

Claim Online

  1. Visit the official settlement website to access the FLSA Opt-In and Release Form.
  2. Complete and submit the form electronically.
  3. Submit your form by June 4, 2026. Class members who do not submit an opt-in form may still receive a base payment automatically — but submitting the opt-in form increases your payment by approximately 10%.

Claim by Mail

  1. Complete the FLSA Opt-In and Release Form that was mailed to you, or download it from the settlement website.
  2. Mail the completed form to Atticus Administration.
  3. Your form must be postmarked by June 4, 2026.

Class members receive payment based on length of employment without requiring proof of purchase. Those who paid defendants money for early resignation receive approximately 50% reimbursement. Additional 10% increase available for those who opt into the FLSA Settlement Collective.

CommuniCare settlement payments are variable and depend on each class member’s individual circumstances. Your payment is calculated based on how long you worked for CommuniCare — the longer you worked, the more you receive. If you previously paid CommuniCare money in connection with leaving before your contract ended, you’ll receive approximately half of that amount back. Submitting an FLSA Opt-In and Release Form increases the base portion of your payment by approximately 10%. Payments will be made by check or, if you used direct deposit with CommuniCare, to the last bank account on file. You can also elect to receive payment via a different bank account or Zelle by contacting the settlement administrator. Payments will be issued after the court grants final approval at the hearing scheduled for July 8, 2026.

Background of the Lawsuit

Plaintiff Ariane Rose Villarin filed this lawsuit against Healthcare Facility Management, LLC, doing business as CommuniCare Family of Companies, and WorldWide HealthStaff Solutions, LLC, in the U.S. District Court for the Southern District of Ohio. The case was brought as both a class action and a collective action on behalf of foreign-trained nurses CommuniCare sponsored through the immigration process.

The lawsuit challenged the defendants’ employment practices, including the terms of contracts between CommuniCare and WorldWide and their healthcare workers. Allegations included claims about the legality and enforceability of certain contract provisions, including requirements that nurses pay money back to CommuniCare or WorldWide if they resigned before the end of their contract. The FLSA claims also alleged failures to pay all compensable hours, unpaid overtime, and unlawful kickbacks.
