Background of the Lawsuit

This class action settlement resolves allegations that the Charlotte-Mecklenburg Hospital Authority, in operating Atrium Health Urology, failed to maintain adequate records to determine whether proper procedures were followed in the sterilization or high-level disinfection of reusable medical instruments. Because of these alleged record-keeping failures, CMHA contacted patients treated at AH Urology between April 1, 2021 and September 22, 2022 and advised them to undergo blood testing for infectious diseases.

Named Plaintiffs Monica Jackson and Keith Grays underwent testing and received negative results. They filed suit on behalf of all similarly situated patients, alleging negligence by CMHA and its employees. CMHA denies any and all alleged wrongdoing.

Rather than proceed to trial, both sides agreed to settle.
