  • Were charged a late fee by USAA General Indemnity Company, Garrison Property and Casualty Insurance Company, United Services Automobile Association, or USAA Casualty Insurance Company on a Maryland insurance policy prior to 2020
  • Received a refund for those late fee charges pursuant to Maryland Consent Order MIA-2020-08-002
  • Did not receive accrued interest and/or gains on the late fee refund

USAA settlement payments are calculated based on the number of late fees charged to each class member and when those fees were refunded. Each member receives a minimum $5 payment. The remaining net settlement fund is allocated proportionately using an 8 percent per annum simple interest calculation. Current policyholders receive statement credits; former policyholders receive checks.

Background of the Lawsuit

USAA charged late fees to Maryland insurance policyholders for payments not made by the required deadline. In a market conduct examination, the Maryland Insurance Commissioner determined USAA was not authorized to charge these fees after withdrawing its billing plans in 2011. USAA entered into a Consent Order and refunded the principal amount of late fees to affected policyholders, but did not include accrued interest and gains made on those fees.

Plaintiffs alleged that class members should have received interest and monetary gains in addition to the principal refunds. USAA denied any wrongdoing. Rather than continue litigation, the parties agreed to settle the claims. The settlement provides a $5 million fund to be distributed among class members. USAA maintains that it did nothing wrong and settled to avoid further expense and litigation risk.

The deadline to opt out or object is March 30, 2026. Opt-out requests and objections must be postmarked by this date and sent to the Settlement Administrator at PO Box 91109, Seattle, WA 98111.
Your payment depends on the number of late fees charged to you and when they were refunded. Each class member receives at least $5. Remaining funds are allocated proportionately based on 8 percent simple interest calculated on your late fee amounts. The exact amount also depends on total class member participation.

Yes. If you opt out by March 30, 2026, you retain the right to pursue your own lawsuit against USAA about the same late fee issues. If you do not opt out, you are bound by the settlement and cannot sue separately.
