Who’s Eligible

  • Filed a Chapter 7 or Chapter 13 bankruptcy petition in either the Western District of Kentucky or Eastern District of Kentucky;
  • Had a loan originated through and/or serviced by Defendant; and
  • Were sent one or more post-filing Communications between January 1, 2018 and December 31, 2024 from Defendant more than five days after their bankruptcy petition was filed and while their bankruptcy petition remained pending.

Upstart settlement payments will vary based on the nature of the violation. Class Members who made payments to Upstart after filing for bankruptcy may receive a refund of those payments plus an additional $800. Class Members subject to certain credit reporting actions may receive $100. Those who received communications may receive a pro rata share of the remaining funds.

Background of the Lawsuit

Plaintiffs Melanie Stephens and Jessica Johnson filed a class action lawsuit against Upstart Network in the United States Bankruptcy Court for the Eastern District of Kentucky. A matching action was filed by David Brody in the Western District of Kentucky. The complaints allege that Upstart violated the automatic stay in certain bankruptcies by sending communications, collecting payments, and reporting credit information after the plaintiffs had filed for bankruptcy.

Upstart denies these allegations and any wrongdoing. The Court has not determined who is right or wrong in this lawsuit.

Upstart has agreed to pay up to $300,000 to resolve the claims. An additional fund will cover administrative costs and attorneys’ fees.

Upstart established a $300,000 Settlement Fund. Payments include refunds plus $800 for collected payments, $100 for credit reporting issues, and pro rata shares for communications.
You do not need to do anything. If you are a Class Member and do not opt out, the Settlement Administrator will mail a check to you automatically.
Checks will be mailed after the Court grants final approval and any appeals are resolved. The distribution date is approximately 15 business days after the Effective Date.
Yes. If you do not want to participate, you must submit an Opt Out Request by March 9, 2026. You will not receive a payment if you exclude yourself.
You may file an Objection with the Court by March 9, 2026, explaining why you do not like the settlement.
