Settlement Payout

Estimated Payout Per Person

State Farm settlement payments to Missouri policyholders vary based on claim size and depreciation amount. Eligible claimants receive 90% of withheld non-material depreciation plus 50% of general contractor overhead and profit depreciation, plus 8.9% annual simple interest from August 6, 2021 onward, or interest only if replacement cost benefits were already recovered. Payments exclude claims exhausting insurance limits and certain policy forms expressly permitting labor depreciation.

Background of the Lawsuit

The lawsuit alleged that State Farm improperly deducted non-material depreciation and general contractor overhead and profit depreciation when calculating actual cash value (ACV) payments for structural damage claims made by Missouri policyholders. The case covered claims with dates of loss between June 5, 2012 and approximately October 2017.

State Farm denied all allegations of wrongdoing, contending that policyholders received everything they were entitled to under their policies, including replacement cost benefits. The parties settled to avoid ongoing litigation costs and allow eligible claimants to receive compensation.

Frequently Asked Questions

Who qualifies for payment in the State Farm settlement?
You qualify if you are a Missouri property owner insured by State Farm, made a structural damage claim between June 5, 2012 and October 2017, and State Farm deducted non-material or contractor overhead depreciation from your ACV payment or denied payment because such deductions dropped the ACV below your deductible.
Your payment amount depends on your specific claim. You receive 90% of withheld non-material depreciation and 50% of withheld contractor overhead depreciation, plus 8.9% annual interest from August 6, 2021, or interest only if you already recovered depreciation through replacement cost benefits. Submit a Claim Form for State Farm to calculate your exact amount.
You must submit your Claim Form by April 2, 2026, either by mail (postmarked by that date) or uploaded to the settlement website before midnight Central Time.
You do not need proof of purchase or loss. State Farm will review its records to determine your eligibility and payment amount based on the information in your Claim Form.

If you do nothing, you will not receive a payment. However, you will still be bound by the settlement and cannot sue State Farm over the claims it resolves unless you opt out before January 30, 2026.
Payments will be mailed after the Court grants final approval of the settlement, any appeals are resolved in favor of the settlement, and the claims administration process is completed. This process can take several months.
