To get paid from the Saratoga Harness Racing settlement:
$50 flat payment with no proof required, or up to $2,500 for documented out-of-pocket losses (receipts and supporting documentation required).
Saratoga Harness Racing settlement payments are either $50 or up to $2,500 depending on your claim type. Claimants can choose Cash Payment B for a flat $50 payment with no proof required, or Cash Payment A for up to $2,500 to reimburse documented out-of-pocket losses from the data breach. All claimants also receive one year of credit monitoring with $1 million identity theft insurance. Payments will be distributed after the court approves the settlement and any appeals are resolved.
In November 2024, Saratoga Harness Racing suffered a targeted cyberattack on its computer systems. Certain files containing personal information, including names, Social Security numbers, and driver’s license/state identification numbers, were accessed during the breach. Class members were those whose information was potentially compromised or who received notification of the incident.
Plaintiffs Robert Myers, Madison Marcel, Troy Ashline, Tarayl Goss, and Mary Dell Payne filed a class action lawsuit (Myers et al. v. Saratoga Harness Racing, Inc., Case No. EF202598) in the Supreme Court of Saratoga County, New York. The lawsuit alleged that Saratoga failed to protect personal information from the cyberattack.
Saratoga denies wrongdoing, and the court has not decided the case on its merits. The parties agreed to settle to avoid the costs and risks of continuing litigation. The settlement provides class members with credit monitoring, identity theft insurance, and cash payments for documented losses or a flat payment option.
