This is an automatic distribution settlement. You do not need to file a claim. If the Court approves the settlement and you are an identified class member, Rust Consulting will mail a check to your last known mailing address. No action is required on your part to receive payment.
If you want to exclude yourself from the settlement, your written request must be postmarked no later than May 15, 2026 and mailed to Rust Consulting, the settlement administrator.
No proof of employment or medical examination required. Class members receive automatic equal distribution by check mailed to last known address upon final court approval.
NTN Bearing Corporation of America settlement payments are anticipated to be at least $1,500 per class member. All approximately 550 class members will receive an equal share of the $1,427,500 fund after deductions for attorneys’ fees (up to 35% of the fund), administration costs, and service awards for the class representatives.
No claim form is required. If the Court grants final approval, Rust Consulting will mail a check to each class member’s last known address. Payments will only go out after final approval is granted and any appeals are resolved.
The lawsuit, Dal Cerro v. NTN Bearing Corporation of America, alleges that NTN Bearing Corporation of America and its affiliates violated the Illinois Genetic Information Privacy Act (GIPA) by requiring job applicants to disclose family medical history during mandatory pre-employment medical examinations. Illinois enacted GIPA specifically to protect individuals from the risk of discrimination that can arise when employers obtain genetic information, including family members’ medical histories.
The case covers roughly 550 people who applied for jobs with NTN in Illinois and underwent a medical exam between June 19, 2019 and December 20, 2024. NTN denies the allegations and maintains that its examination process complied with applicable laws and regulations.
Rather than continuing litigation, the parties agreed to a $1,427,500 settlement fund. The Court has not decided who is right or wrong, and NTN’s agreement to settle does not constitute an admission of liability.
