What You Need to Do to Get Paid

To get paid from the Norton Healthcare settlement:

Claim Online

  1. Visit the settlement website at nortondataincidentsettlement.com
  2. Complete and submit the online Claim Form by 11:59 p.m. ET on May 18, 2026
  3. If you want payment via electronic transfer, select that option during the online filing process

Claim by Mail

  1. Download the Claim Form from the settlement website or call Kroll Settlement Administration to request a paper copy
  2. Fill out the form completely in blue or black ink, and include any supporting documentation for out-of-pocket loss claims
  3. Mail your completed form to Kroll Settlement Administration so it is postmarked no later than May 18, 2026
  4. Paper claims will be paid by check once distribution is complete

Claimants must submit documentation to support claims. For Out-of-Pocket Losses: bank statements, telephone records, correspondence, or receipts showing expenses traceable to the data incident. For Lost Time: documentation of time spent on incident-related activities. For Medical Monitoring Services and Cash Payment: no additional proof beyond claim submission.

Estimated Payout Per Person

Norton Healthcare settlement payments are at least $5 per valid claim, with the final amount determined on a pro rata basis depending on how many claims are filed. Eligible class members can also claim up to $2,500 for documented out-of-pocket losses tied to the data breach, and up to $80 (4 hours at $20/hour) for lost time. Three years of CyEx Medical Shield Pro medical account monitoring is available as an additional benefit. Paper claims will be paid by check after distribution is complete; online filers can elect electronic payment. Payments will be distributed after the court grants final approval of the settlement and any appeals are resolved.

Background of the Lawsuit

On or around May 9, 2023, Norton Healthcare, Inc. and Norton Hospitals, Inc. experienced a data incident that may have exposed the confidential personal information of current and former patients and employees. A class action lawsuit followed, captioned Abby Berthold, et al. v. Norton Healthcare, Inc., et al., Case No. 23-CI-003349, filed in Jefferson Circuit Court, Division Two in Louisville, Kentucky.

The lawsuit alleges negligence, breach of implied contract, unjust enrichment, and intrusion upon seclusion/invasion of privacy. Norton Healthcare and Norton Hospitals deny all claims and maintain they did nothing wrong.

Rather than proceed to trial, the parties agreed to a $11,000,000 settlement. The court has not ruled in favor of either side. The settlement allows eligible class members to claim cash payments, reimbursement for out-of-pocket losses, lost time compensation, and medical account monitoring services.
