Tara Blizzard filed a class action lawsuit against Nationwide Mutual Insurance Company alleging that Defendant sent prerecorded voice messages regarding pet insurance renewal and expiration in violation of the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA). The lawsuit sought actual and statutory damages on behalf of a nationwide class of individuals who received these calls.
Nationwide denied all allegations of wrongdoing and liability. Rather than proceed to trial, both parties agreed to settle the dispute. The settlement avoids the costs and uncertainty of litigation while providing compensation to eligible class members. The Court has not decided who is right.
