Claim Online
Visit the Settlement Website and submit a Claim Form using the Notice ID and PIN provided in your settlement notice.
Claim by Mail
If you received a paper claim form, complete it and mail it to the Settlement Administrator at the address listed on the form. Ensure it is postmarked by the Claim Deadline.
You likely do not need to submit proof to file a claim, as the Settlement Administrator has identified eligible Class Members from Defendants’ records. You will need your Notice ID and PIN from the notice you received.
Mary Jane M. Elliott, Midland, and LVNV settlement payments include a reduction in the judgment balance owed by Class Members. Specifically, the balance will be reduced to reflect interest calculated at lawful rates, plus an additional $500 reduction. If these reductions eliminate the judgment balance entirely, and you file a valid Claim Form, you will receive a cash payment of $150.
The lawsuit alleges that Mary Jane M. Elliott, P.C., Midland Funding, LVNV Funding, and related entities violated federal and Michigan laws by charging excessive post-judgment interest. Specifically, the plaintiffs claim the defendants calculated interest at a rate of 13%—the limit for judgments based on written instruments—when the underlying judgments were not based on such instruments and should have carried a lower, variable interest rate.
The defendants deny any wrongdoing and maintain that their interest calculations were lawful. They contend they have good defenses to the claims alleged in the action. However, to avoid the risk and expense of continued litigation, they have agreed to a settlement.
Under the settlement, the defendants will recalculate the judgment balances using the lower statutory interest rate and provide an additional credit. Class members whose balances are wiped out by these reductions are eligible for a cash payment.
