Background of the Lawsuit

Plaintiff Taliah Mirmalek sued Los Angeles Times Communications LLC in the U.S. District Court for the Northern District of California, alleging the company installed and used three third-party trackers on its website visitors’ browsers without their consent. The trackers in question are the TripleLift Tracker, GumGum Tracker, and Audiencerate Tracker. The lawsuit claims this practice violated Section 638.51(a) of the California Invasion of Privacy Act (CIPA).

The alleged conduct covered visitors to LATimes.com and its subdomains, as well as users of the LA Times mobile app, in California between January 31, 2023 and December 19, 2025. Los Angeles Times Communications denies any wrongdoing and the court has not ruled on the merits.

Rather than continue to trial, both sides agreed to a $3,850,000 settlement fund. The settlement covers eligible California visitors during the class period and provides each valid claimant a proportionate share of the fund after fees, costs, and administration expenses are deducted.
