What You Need
Your Claimant Identification Number (included in your settlement notice), your name, address, phone number(s) covered by the settlement, and preferred payment method (check, PayPal, Venmo, or Zelle).
No proof of purchase or receipt required to submit a claim. Settlement class members can file a claim based on their association with qualifying telephone numbers registered on the National Do Not Call Registry.
Keller Williams Realty Landmark settlement payments are distributed on a pro rata basis per telephone number to all class members who submit valid claim forms. The actual amount each person receives depends on the total number of approved claims and the remaining funds after settlement administration costs, attorneys’ fees, and the service award are deducted.
Stacy Nicotra filed a class action lawsuit against Keller Williams Realty Landmark (d/b/a Bayside NY Homes LLC), alleging the company sent telemarketing text messages to consumers whose telephone numbers were registered on the National Do Not Call Registry in violation of the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227. The plaintiff claimed she received multiple unsolicited text messages from a Keller Williams agent about expired property listings without her consent, despite having registered her phone number on the Do Not Call Registry to avoid such solicitations.
Defendant denied all allegations and maintained it had strong legal defenses. Rather than proceed through trial and appeals, both parties agreed to settle the case. The settlement was reached after mediation with JAMS mediator Bruce A. Friedman on October 8, 2025. The court has not decided who is right, and the defendant’s agreement to settle does not constitute an admission of wrongdoing or liability.
