Fandom settlement payments depend on the number of valid claims filed. Each Class Member who submits a valid Claim Form receives a proportionate share of the Settlement Fund, minus attorneys’ fees, settlement administration costs, and incentive awards. Background of the Lawsuit

The lawsuit alleges that Fandom, Inc. installed and used three tracking technologies on GameSpot website visitors’ browsers without their consent. These trackers, known as the GumGum Tracker, Audiencerate Tracker, and TripleLift Tracker, allegedly collected visitors’ IP addresses and other personal information in violation of California’s Invasion of Privacy Act (CIPA), specifically Section 638.51(a).

The case was filed in January 2024 in the U.S. District Court for the Northern District of California. Fandom denied all allegations of wrongdoing and maintained that it has meritorious defenses to the claims. Rather than proceed through class certification, summary judgment, and trial, both parties agreed to settle the case to avoid the uncertainties and costs associated with ongoing litigation.

On December 16, 2025, the court granted preliminary approval of the settlement. The settlement resolves all claims related to the alleged unauthorized collection of personal information through these trackers. Fandom has agreed to pay $1.2 million to settle the claims, which will be distributed to eligible Class Members on a pro rata basis.
