Eligible States
To receive a payment, you must submit a Claim Form by January 20, 2026. You can file online at the settlement website using your Class Member ID (if you received a notice) or by providing your contact information and attesting to your purchase history. If you prefer, you may print a paper claim form and mail it to the Settlement Administrator.
Proof of purchase is not strictly required to submit a claim, as eligibility is primarily based on DirectToU’s internal records. However, you must certify under penalty of perjury that you purchased a video or videogame from a DirectToU brand or signed up for their notices during the class period.
Class Counsel estimates that each valid claimant will receive a cash payment between $60.00 and $145.00. The final amount depends on the total number of valid claims filed.
This lawsuit alleges that DirectToU, LLC and Alliance Entertainment, LLC violated the Video Privacy Protection Act (VPPA) by sharing customers’ personally identifiable information (PII) with third parties like Facebook via tracking pixels without obtaining proper consent. The shared data allegedly identified specific video materials or services requested by customers. The defendants deny these allegations and any wrongdoing but have agreed to settle to avoid the cost and risk of trial.
