Who’s Eligible

You are eligible if you are a member of the Settlement Class, defined as:

  • All living individuals in the United States whose PII was potentially compromised in the Data Incident.

Excluded from the Settlement Class are:

  • All persons who are directors, officers, and agents of Defendant;
  • Governmental entities; and
  • The Judge assigned to the Action, that Judge’s immediate family, and Court staff.

What You Need to Do to Get Paid

You can submit a Claim Form using one of the following methods:

  • Online: Visit www.DPDataSettlement.com and submit the form by February 5, 2026.
  • Mail: Mail a completed Claim Form to the Settlement Administrator, postmarked no later than February 5, 2026.

For Documented Out-of-Pocket Losses, you must submit third-party documentation supporting your claims (e.g., receipts not self-prepared). No proof is required for the Flat Cash Payment ($95) or Credit Monitoring.

Estimated Payout Per Person

Settlement Class Members may submit a Valid Claim for one of the following benefits:

  • Flat Cash Payment: A cash payment of $95.00. This amount is subject to pro rata reduction if the total Cash Payments exceed the $400,000 cap.
  • Documented Losses: Compensation for documented out-of-pocket unreimbursed losses fairly traceable to the Data Incident, up to a total of $4,000.00 per person.
  • Credit Monitoring: Three years of one-bureau Credit Monitoring Services with at least $1,000,000 in identity protection insurance.

Background of the Lawsuit

On or about December 6, 2024, DecoPac announced that there was unauthorized access to or acquisition of Plaintiff’s and Settlement Class members’ PII in Defendant’s possession. The lawsuit alleges that Personal Information was potentially compromised by the Data Incident. The Parties have agreed to settle to avoid the uncertainties and costs of continued litigation.
