You do not need to file a claim to receive a payment.
No proof is required. Payments are automatic for eligible Class Members identified in Capital One’s records.
Settlement Class Members will receive a pro rata share of the Net Settlement Fund. Payments are automatic for those who do not exclude themselves.
The lawsuit alleges that Capital One violated the Fair Credit Reporting Act (FCRA) by failing to properly investigate disputes from credit card holders whom it incorrectly reported as deceased to credit reporting agencies. Capital One denies the allegations but agreed to settle to avoid the cost and risk of litigation.
