Capital Health settlement payments range from $100 for an alternative flat payment to up to $5,000 if you submit documentation of losses related to the data breach. You may also receive three years of free credit monitoring valued at $90 per year. Actual payments may be adjusted on a pro rata basis depending on the number of valid claims received.

Background of the Lawsuit

Between November 11 and November 26, 2023, Capital Health Systems, Inc. experienced an IT systems outage during which an unauthorized third party may have gained access to private information stored in the defendant’s systems. The compromised information included names, addresses, dates of birth, Social Security numbers, email addresses, telephone numbers, clinical information, and other personal data belonging to patients, former patients, guarantors, and employees.

Plaintiffs filed a class action lawsuit alleging claims for negligence, negligence per se, breach of implied contract, breach of fiduciary duty, unjust enrichment, declaratory judgment, and violation of the New Jersey Consumer Fraud Act. The defendant denies the legal claims and any wrongdoing or liability. The Court has not made any determination regarding wrongdoing. Plaintiffs and Capital Health agreed to settle the case to avoid the risks, costs, and time of continued litigation.

Who qualifies for the Capital Health settlement?
You qualify if your private information was potentially compromised in the Capital Health data breach between November 11-26, 2023, and you were a patient, former patient, guarantor, or employee of Capital Health Systems, Inc.

The Final Approval Hearing is scheduled for July 14, 2026, at 11:00 a.m. Eastern before the United States District Court for the District of New Jersey. Check the website to confirm the date has not changed.
The opt-out deadline was March 9, 2026, and has passed. You can no longer exclude yourself from the settlement.
The breach potentially exposed names, addresses, dates of birth, Social Security numbers, email addresses, telephone numbers, clinical information, and other personal data stored in Capital Health’s systems at the time of the incident.
