To get paid from the Balance Autism settlement:
Credit Monitoring and Alternative Cash Payment require no documentation. Lost Time requires attestation under penalty of perjury describing activities. Ordinary Losses require third-party documentation (receipts, bills). Extraordinary Losses require third-party documentation proving fraud/identity theft causation; self-prepared documents alone insufficient.
Balance Autism settlement payments are up to $4,000 per person for documented extraordinary losses such as identity theft or fraud directly linked to the data breach. Class members who experienced ordinary out-of-pocket expenses can claim up to $400, and those who spent time dealing with the breach can claim up to four hours at $20 per hour, capped at $80. If you’d rather skip the documentation, there’s a flat $50 cash payment option available instead. Credit monitoring alone requires no documentation and is available to all eligible claimants. Payments will be issued after the court grants final approval, with the Final Approval Hearing scheduled for June 12, 2026. Mail claimants receive a physical check; online claimants can opt for electronic payment.
Plaintiff Andrea Bennett filed a lawsuit against Balance Autism in the Iowa District Court for Polk County, Case No. CVCV069538. The lawsuit alleges that on or around March 11, 2025, Balance Autism suffered a cybersecurity incident that exposed the personal information of individuals stored in its systems. The plaintiff claims she and others were harmed by the unauthorized access to their data.
Balance Autism denies all allegations of wrongdoing or liability. The court has not determined whether either side is correct. Both parties agreed to settle to avoid the uncertainty and expense of continued litigation, and class counsel believes the settlement terms are fair and reasonable.
