  • Excluded from the Settlement Class are directors and officers of the Defendant, governmental entities, the Judge assigned to the lawsuit, the Judge’s immediate family, and Court staff.

Documentation is required for Cash Payment A (Documented Losses) to prove expenses. No documentation is required for Cash Payment B ($40 Alternate Cash).

Settlement Payout

Estimated Payout Per Person

Settlement Class Members may select one of the following benefits:

  • Cash Payment A (Documented Losses): Reimbursement of up to $5,000 for documented out-of-pocket losses reasonably related to the Data Incident (e.g., bank fees, communication charges, credit monitoring costs).
  • Cash Payment B (Alternate Cash): A cash payment of $40 (subject to pro rata reduction if claims exceed the $1 million cap). No documentation is required.
  • Credit Monitoring: All Class Members automatically receive three years of free Credit Monitoring services (no claim form needed).
Settlement Fund Breakdown
  • Cash Payment Cap: $1,000,000 (payments reduced pro rata if exceeded)
  • Attorneys’ Fees & Costs: Up to $815,000 (paid separately)
  • Service Awards: Up to $2,000 per Class Representative
