To get paid from the 301 Scrubs settlement:
Cash Payment A (up to $2,500) requires documented proof of out-of-pocket losses such as receipts. Cash Payment B ($50) requires no proof. Credit monitoring available to all without proof.
301 Scrubs settlement payments are either a flat $50 with no documentation required, or up to $2,500 if you can show documented out-of-pocket losses tied to the June 2024 data breach. You can only choose one cash payment option. All class members are also eligible to enroll in two years of CyEx Identity Defense Complete credit monitoring, which includes $1 million in identity theft insurance. Online claimants can receive cash via PayPal, Venmo, or Zelle; those who mail in a claim will receive a check. Payments will be distributed after the court grants final approval and any appeals are resolved.
In June 2024, a targeted cyberattack hit 301 Scrubs Investors, LLC, which does business as Scrubs & Beyond and Kindthread. The attack accessed files containing private information, potentially including names, Social Security numbers, dates of birth, and employee identification numbers.
Plaintiff Kevin Mitchael filed suit in the Judicial Circuit Court for Broward County, Florida, alleging the company failed to adequately protect that data. The case is captioned Kevin Mitchael v. 301 Scrubs Investors, LLC d/b/a Scrubs & Beyond, LLC d/b/a Kindthread, Case No. CACE-26-000716.
301 Scrubs denies any wrongdoing. The court has not ruled on the merits. Both sides agreed to settle to avoid the costs and uncertainty of trial, and the settlement is pending final approval scheduled for June 2, 2026. For more information, visit the official settlement website.
