Sirius XM settlement payments will be distributed on a pro rata basis to all eligible class members who submit valid claim forms. The amount each person receives depends on the number of valid claims submitted and will be paid after the settlement is approved and becomes final. This lawsuit alleges that Sirius XM made telephone calls to people registered on the National Do Not Call Registry or Sirius XM’s Internal Do Not Call Registry in violation of do-not-call laws. The case, Campbell et al. v. Sirius XM Radio Inc., was filed on November 29, 2022 in the United States District Court for the Central District of Illinois.
Sirius XM denies any wrongdoing, and the court has not decided who is right. Rather than proceed to trial, the parties have agreed to settle the case. The settlement provides for a $28 million fund to compensate class members who received such calls, along with funds for notice, administrative costs, attorneys’ fees, and incentive awards for the named plaintiffs.
The settlement also requires Sirius XM to implement enhanced business practices for its telemarketing operations, including improved do-not-call compliance procedures and monitoring technologies.
