To get paid from the Long Island Plastic Surgical Group settlement:
Settlement Class Members claiming Documented Monetary Losses must submit documentation supporting their claims (receipts or other non-self-prepared documentation). Alternative Pro Rata Cash Payment requires no additional documentation.
Long Island Plastic Surgical Group settlement payments are up to $5,000 per person for documented monetary losses traceable to the data breach. Eligible losses include unreimbursed fraud or identity theft costs, professional fees, credit monitoring expenses, credit freeze costs, and miscellaneous out-of-pocket expenses. Documentation is required to support these claims.
Patients who don’t have documented losses can instead claim an alternative pro rata cash payment. The amount of that payment isn’t fixed — it depends on how much money remains in the $2,600,000 settlement fund after fees, costs, and documented loss claims are paid. Patients whose clinical photographs were compromised may also claim an additional payment of up to $1,000 on top of either option.
Payments will be issued after the settlement receives final court approval. You can choose to receive your payment by digital transfer or by check mailed via First-Class Mail.
On or about January 4, 2024, an unauthorized user gained access to computer systems belonging to Long Island Plastic Surgical Group, P.C. (LIPSG), a plastic surgery practice based in New York. The breach exposed sensitive personal information belonging to current and former patients, including names, Social Security numbers, dates of birth, addresses, phone numbers, driver’s license numbers, medical and health insurance information, clinical photographs, financial account information, and payment card data.
Patients filed several class action lawsuits in the Supreme Court of the State of New York, Nassau County, under the case name Baum et al. v. Long Island Plastic Surgical Group, P.C., Index No. 618453/2024. The plaintiffs alleged LIPSG failed to adequately protect their personal information and that they were harmed as a result.
LIPSG denies any wrongdoing, negligence, or fault. No court has found that LIPSG violated any law. The parties agreed to settle to avoid the risks and costs of continued litigation. As part of the settlement, LIPSG has also agreed to implement enhanced security measures. For more information, visit the official settlement website.
