Eligible States
To get paid from the HopSkipDrive Data Breach settlement:
Visit the settlement website at https://hopskipdrivedatasettlement.com/ and submit your claim form online. Be prepared to provide documentation of your identity and membership in the class.
Print the claim form from the settlement website, complete it, and mail it along with supporting documentation to the settlement administrator. Instructions for mailing will be provided on the settlement website.
Class members can receive the Additional Cash Payment (approximately $100) without providing any documentation, only their Unique ID number. Documented Out-of-Pocket Loss Payments require reasonable documentation such as credit card statements, bank statements, invoices, telephone records, and receipts. California Statutory Cash Payments require proof of California residency, satisfied by sworn attestation.
HopSkipDrive settlement payments include two years of expanded identity theft and fraud monitoring with up to $1 million in insurance, plus cash payments. Class members can claim up to $5,000 for documented out-of-pocket losses, up to $125 for time spent responding to the breach, and approximately $100 in additional cash payments. California residents may receive an additional $250 statutory payment.
Between May 31 and June 10, 2023, HopSkipDrive experienced a cybersecurity attack that compromised its computer systems. During the attack, a threat actor accessed database files containing sensitive personal information, including names, addresses, email addresses, Social Security numbers, dates of birth, driver’s license numbers, and medical information. HopSkipDrive began notifying affected individuals around November 14, 2023.
Class members filed a lawsuit (Benavides, et al. v. HopSkipDrive, Inc.) alleging that HopSkipDrive failed to adequately protect their personal information and that they were injured as a result. HopSkipDrive denied any wrongdoing and no court determined that any law was violated. The parties agreed to settle the case to avoid the risks and uncertainties of continued litigation.
Under the settlement, HopSkipDrive established a $1,985,000 fund to provide class members with two years of identity theft and fraud monitoring services with up to $1 million in insurance coverage, reimbursements for documented losses and time spent responding to the breach, and additional cash payments.
