Granite Wellness Centers settlement payments are up to $750 in cash or up to $5,000 in documented loss reimbursement, plus an additional $100 for California residents. All payouts are subject to pro-rata adjustment based on the total number of valid claims filed. Payments will be distributed after the court grants final approval and any appeals are resolved.

Background of the Lawsuit

Granite Wellness Centers (GWC) experienced a data security incident on January 5, 2021, that potentially exposed personally identifiable information (PII) and protected health information (PHI) of patients, including names, dates of birth, addresses, treatment details, health insurance information, driver’s license numbers, medical histories, Social Security numbers, and bank account numbers. GWC sent notices of the breach to affected individuals on or around March 6, 2021.

The consolidated class action lawsuit alleged that GWC failed to take appropriate care to protect patient data, asserting claims for negligence, negligence per se, breach of implied contract, unjust enrichment, and declaratory judgment. GWC denied all allegations and maintained it did not act wrongfully and that the data exposure caused no harm to individuals.

The parties agreed to settle to avoid litigation costs and risks. The settlement provides cash payments and documented loss reimbursement to eligible class members. The settlement does not constitute an admission of wrongdoing by GWC.
