Eureka Casino Hotel settlement payments vary depending on the type of claim submitted. Class members with documented out-of-pocket losses traceable to the data breach can claim reimbursement of up to $5,000, provided they submit supporting documentation. California residents are eligible for an additional flat $100 payment. All class members who file a valid claim will also receive a share of whatever funds remain in the settlement after other expenses are paid, distributed on a pro rata basis. The exact pro rata amount will depend on how many valid claims are submitted. Payments can be received via PayPal, Venmo, Zelle, or check.
A class action lawsuit filed in the U.S. District Court for the District of Nevada, known as In re: Eureka Casino Breach Litigation (Case No. 2:23-cv-00276-CDS-NJK), alleges that Rancho Mesquite Casino, Inc., doing business as Eureka Casino Hotel, experienced a data security incident between November 9 and 13, 2022. Plaintiffs claim that during this window, unauthorized parties copied personal information from Eureka’s computer network, including full names, Social Security numbers, financial account numbers, passport numbers, and driver’s license or state-issued ID numbers.
The lawsuit was filed on behalf of all U.S. residents whose private information was compromised in the incident. Eureka Casino Hotel denies any wrongdoing and disputes the plaintiffs’ claims. The court has not made a finding in favor of either side.
To avoid the cost and uncertainty of continued litigation, both sides agreed to a $1,000,000 settlement fund. Class members who submit valid claims can receive reimbursement for documented out-of-pocket losses up to $5,000, a $100 cash payment if they are California residents, and a share of any remaining settlement funds distributed on a pro rata basis.
