Class Members can submit a claim for one of the following benefits:

  • Alternative Cash Payment: A flat cash payment of $60.00 (no documentation required).
  • Expense Reimbursement: Payment for documented losses up to $5,480.00, which includes:
    • Ordinary Losses: Up to $400 for out-of-pocket expenses.
    • Extraordinary Losses: Up to $5,000 for identity theft damages.
    • Lost Time: Up to $80 ($20/hour for up to 4 hours).
  • Credit Monitoring: Two years of one-bureau credit monitoring and $1 million in identity theft insurance.

  • Benefits Cap: $245,000 (aggregate cap for monetary claims)
  • Attorneys’ Fees: Up to $193,000
  • Service Awards: $9,000 ($3,000 per Representative)
  • Notice & Admin Expenses: Up to $13,867

Background of the Lawsuit

The lawsuit alleges that Elyria Foundry Holdings, LLC failed to implement adequate data security measures, resulting in a June 2024 cyber-attack that exposed the Personally Identifiable Information (PII) of current and former employees and their families. Elyria denies all allegations of wrongdoing but agreed to settle to avoid the cost and risk of litigation.
