  • The property must be located within the Class Area defined in the lawsuit.
  • Excluded: Individuals who sold their property after the incident without disclosing the fuel jettison to the purchaser.
  • Excluded: Individuals who filed a separate claim in court against Delta Air Lines arising from the January 14, 2020 incident.
  • Excluded: Employees, officers, and directors of Delta, Class Counsel, and judicial staff.

What You Need to Do to Get Paid

Submit a Claim Form online at the settlement website or by mail to the Settlement Administrator. You must include required documentation for proof of ownership/residence and identity. All claims must be postmarked or submitted online by February 6, 2026.

The Net Settlement Fund will be divided: 67% to the Owners’ Settlement Fund and 33% to the Residents’ Settlement Fund. The Owners’ Fund is divided equally on a per-property basis. The Residents’ Fund is divided equally among all eligible resident claimants. Exact amounts depend on the number of valid claims.
