- All natural persons residing in the United States whose Private Information was compromised in the Data Breach of Dakota Eye Institute LLC.
- The breach was disclosed to the public on or about October 31, 2023.
- Excluded are the Judge and court staff, Defendant’s officers and directors, and persons found guilty of causing the Data Breach.

What You Need to Do to Get Paid
To qualify for a cash payment or other benefits, you must complete and submit a Claim Form by January 12, 2026. You may file online at the settlement website or by mail. Be sure to include all required information, documentation for loss claims, and your signature.
You must provide proper documentation to make a successful claim for Out-of-Pocket Losses or Extraordinary Losses. Documentation may include receipts, invoices, or other documents prepared by a third party.
Settlement Payout
Settlement Class Members may file a claim for one or more of the following benefits:
- Ordinary Out-of-Pocket Losses up to $1,000 for unreimbursed costs traceable to the Data Breach;
- Extraordinary Losses up to $5,000 for monetary loss arising from identity theft;
- A cash payment of $45 (subject to pro rata adjustment); or
- Two years of credit monitoring services.
- Settlement Fund: $1,000,000
- Attorneys’ Fees and Expenses: $350,000
- Service Awards: $2,000 per Class Representative

The lawsuit claims that in October 2023, an unauthorized third party gained access to Dakota Eye Institute’s system and removed certain files containing Private Information such as names, dates of birth, and Social Security numbers.
