  1. Ordinary Out-of-Pocket Losses up to $1,000 for unreimbursed costs traceable to the Data Breach;
  2. Extraordinary Losses up to $5,000 for monetary loss arising from identity theft;
  3. A cash payment of $45 (subject to pro rata adjustment); or
  4. Two years of credit monitoring services.

Background of the Lawsuit

The lawsuit claims that in October 2023, an unauthorized third party gained access to Dakota Eye Institute’s system and removed certain files containing Private Information such as names, dates of birth, and Social Security numbers. Plaintiffs allege negligence and other violations, while Dakota Eye Institute denies all allegations of wrongdoing.

What does the Settlement provide?
Under the Settlement, the Defendant will establish a non-reversionary settlement fund not to exceed One Million Dollars ($1,000,000). These funds will be used to pay for valid claims, notice and administration costs, service awards, and attorneys’ fees.
The Settlement Class is defined as all natural persons residing in the United States whose Private Information was compromised in the Data Breach of Dakota Eye Institute LLC, which was disclosed to the public on or about October 31, 2023.
The Court will hold a Final Approval Hearing on January 12, 2026. Payments and credit monitoring services will be made after the Settlement is approved and becomes final, which may take more than a year if there are appeals.
If you do nothing, you will not receive a cash payment or credit monitoring services from this Settlement, and you will give up your right to sue the Defendant about the issues resolved by this Settlement.
No. Unless you exclude yourself (opt out), you give up the right to sue the Defendant for the claims resolved by this Settlement. You must opt out by December 13, 2025, to keep your right to sue.
